Senator Schumer is pretty sure that the Supreme Court is not one of the equal but separate branches of government, so as such it’s possible that Chuck’s advised the White House that they have the power to tell the Supreme Court what to do To sum up, the Acting Solicitor General had the audacity to file a brief in a case to which the federal government is a party. Apparently, the Acting Solicitor General has it in his head that he has the authority to act as the Solicitor General. Who knows where he got that idea? Maybe he read his business card. Maybe when people see him they say, "hi, Acting Solicitor General." Or maybe he's just mad with power — specifically, the power of being the Acting Solicitor General.
If I'm going to find anything outrageous here, it's going to be the fact that we still have an "Acting Solicitor General". Kagan has been on the Court for more than half a year. Has a new SG even been nominated?
