Idle thoughts of a relatively libertarian Republican in Cambridge, MA, and whomever he invites. Mostly political.

Saturday, January 15, 2011 :::
The entire reason I'm posting this link to an arcane judicial argument over procedural details related to the jurisdiction of bankruptcy courts is for the sentence, "CA9, bless them, were unphased by textual clarity." That would be the ninth circuit court of appeals.
(The issue is that bankruptcy courts are not normal "Article 3" courts, nor are their judges normal federal judges, and the proceedings of the bankruptcy court itself is always nominally (and sometimes in practice more heavily) under the supervision of a proper district court. There's an issue related to the timing of a decision; the bankruptcy court ruled before an event in a related but independent civil case, but the district court affirmed the ruling afterward. It seems to make a big difference which date counts.)
